Effective Date: January 1, 2026
These Terms and Conditions ("Terms") govern your use of the website located at calexicoinsulation.com (the "Site") and your engagement of services provided by Calexico Insulation ("we," "us," or "our"). By using the Site or requesting or receiving services from us, you agree to these Terms. If you do not agree, please do not use the Site or engage our services.
By accessing this Site or contacting us to request services, you confirm that you are at least 18 years of age, have the legal authority to agree to these Terms, and agree to be bound by them. We reserve the right to update these Terms at any time. Changes will be posted on this page with a revised effective date. Continued use of the Site or our services after changes are posted constitutes your acceptance of the updated Terms.
Calexico Insulation provides residential and commercial insulation services in Calexico, CA and the surrounding Imperial Valley region. Services may include but are not limited to: spray foam insulation, attic insulation, blown-in insulation, wall insulation, crawl space insulation, vapor barrier installation, air sealing, and insulation removal.
All services are subject to a written estimate and a separate service agreement between you and Calexico Insulation. The Site is informational in nature and does not constitute an offer or guarantee of service availability or pricing.
Free estimates are offered as a courtesy and are not binding commitments. A written estimate provided after an on-site assessment represents our good-faith assessment of the scope and cost of work based on conditions observed at the time of the visit. If conditions change or unforeseen issues are discovered during the course of work, we will notify you and provide an updated estimate before proceeding with additional work.
Prices quoted in estimates are valid for 30 days from the date of issue unless otherwise stated in writing. We are not obligated to honor a quoted price after that period or if the scope of work changes materially from what was originally assessed.
Work will be scheduled by mutual agreement after you accept a written estimate. We ask that you notify us at least 48 hours in advance if you need to cancel or reschedule a confirmed appointment. Repeated cancellations or no-shows may result in a cancellation fee or our refusal to reschedule, at our discretion.
We will make reasonable efforts to arrive within the agreed time window. We are not liable for delays caused by traffic, weather, or circumstances beyond our control. If we are unable to perform the work on the scheduled date, we will contact you as soon as possible to reschedule.
Payment terms will be specified in your written estimate or service agreement. For most residential jobs, payment is due upon completion of work unless otherwise agreed in writing in advance. For larger commercial or multi-phase projects, we may require a deposit or progress payments as outlined in the service agreement.
Accepted payment methods will be communicated at the time of estimate. If payment is not received by the due date, we reserve the right to charge a late fee and to pursue collection of outstanding balances through lawful means, including filing a mechanics lien against the property where permitted by California law.
Any disputes about an invoice must be communicated in writing within 10 days of the invoice date. Disputes raised after that period may be subject to the full invoiced amount.
To allow us to complete work safely and effectively, you agree to:
Where required by California state law or the City of Calexico building department, we will obtain applicable permits before beginning work. Permit fees, when required, will be included in or added to your written estimate. We perform all work in accordance with applicable California energy codes and building standards. You are responsible for ensuring that any work requiring a homeowner permit - where you are acting as your own contractor - complies with applicable laws.
We stand behind the quality of our workmanship. If a defect in our installation is identified within one year of the job completion date, contact us and we will assess and address the issue at no charge, provided the defect is due to our installation and not to subsequent damage, alteration, or misuse.
Manufacturer warranties on materials (such as foam products or vapor barrier materials) are separate from our workmanship warranty and are subject to the terms set by the manufacturer. We will provide documentation for any applicable product warranties upon request.
The Site and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the information on the Site is accurate, complete, or current. We are not responsible for errors or omissions in Site content.
To the fullest extent permitted by law, Calexico Insulation will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or from the performance or non-performance of any services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to services performed will not exceed the total amount paid by you to us for the specific job giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct.
If a dispute arises between you and Calexico Insulation relating to services, payment, or these Terms, we ask that you contact us first so we can attempt to resolve the issue informally. Most disputes can be resolved through a direct conversation.
If we cannot resolve a dispute informally, either party may pursue claims in small claims court in Imperial County, California, where the amount at issue falls within that court's jurisdiction. For disputes outside the small claims limit, the parties agree to submit to binding arbitration in Imperial County under the rules of a mutually agreed arbitration provider, rather than resolving disputes through a court proceeding or class action.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration under Section 10 will be brought exclusively in the state or federal courts located in Imperial County, California.
